BSF Nutrition Inc. (“BSF Nutrition,” “BloodSugarFriendly,” “we,” “us,” or “our”)

This Privacy Policy (“Policy”) describes how BSF Nutrition Inc. collects, uses, discloses, and otherwise processes personal information of visitors to and customers of BloodSugarFriendly.comand any other websites, mobile experiences, or online services that link to this Policy (collectively, the “Sites”). By accessing or using the Sites, placing an order, creating an account, subscribing to communications, or otherwise interacting with us, you acknowledge that you have read and understood this Policy.

This Policy does not apply to the privacy practices of any third party we do not own or control, including healthcare professionals, retailers, wholesalers, or other third-party services to which the Sites may link. We are not responsible for the privacy practices of any third party.

By using the Sites, you also agree to our Terms of Service.

1. Scope; Changes to This Policy

This Policy governs the personal information of individuals located in the United States. We may modify this Policy at any time in our sole discretion. When we make material changes, we will revise the “Last Updated” date above and, where required by law, provide additional notice (for example, by posting a notice on the Sites or notifying you by email). Your continued use of the Sites after the effective date of the revised Policy constitutes your acceptance of the changes.

2. Personal Information We Collect

We collect personal information directly from you, automatically through your interactions with the Sites, and from third parties.

2.1 Information You Provide Directly

We collect personal information that you provide to us when you, among other things, create an account, place an order, enroll in a subscription, sign up for our email or SMS programs, contact customer service, participate in a sweepstakes or promotion, submit a product review, or apply for a wholesale account. This may include:

  • Identifiers and contact information: name, billing and shipping address, email address, telephone number, date of birth (where collected).
  • Account credentials: username, password, security questions and answers.
  • Commercial information: products purchased, order history, returns, subscription preferences, payment card information (processed by our payment processor — see Section 4), billing address.
  • Wholesale-account information:business name, business address, federal Employer Identification Number (EIN) or other tax identification, resale or seller’s permit information, primary contact name and title, business email and phone, banking or trade-reference information.
  • Marketing information: preferences for email and SMS communications, survey or research responses, sweepstakes or promotion entries.
  • Customer-service correspondence: communications you send to us, including the contents of emails, chats, and phone calls (which may be recorded where permitted by law).
  • User-generated content: product reviews, ratings, testimonials, photographs, social-media posts tagging us, and other content you submit or post.

2.2 Information Collected Automatically

When you visit or use the Sites, we and our service providers and advertising partners may automatically collect:

  • Device and connection information: Internet Protocol (IP) address, device identifiers, browser type and version, operating system, language preferences, mobile network information, and similar technical data.
  • Usage information: pages and content viewed, links clicked, search queries, products viewed and added to cart, time and duration of visits, referring and exit URLs, and other interaction data.
  • Approximate location: general geographic location derived from IP address.
  • Cookies and similar technologies: as further described in Section 6 below.

2.3 Information from Third Parties

We may receive personal information about you from third parties, including:

  • Payment processors and fraud-prevention services (transaction confirmations, fraud-risk scoring).
  • Shipping carriers and our third-party logistics provider (3PL) (delivery status, address-correction information).
  • Marketing and advertising partners, analytics providers, and social-media platforms (audience attributes, advertising-performance data, information about how you found us).
  • Retailers and wholesalers through which our products are sold (where they share customer or buyer information with us).
  • Co-marketing or co-promotion partners (where you have consented to receive communications from us through them).
  • Publicly available sources (for example, public business directories in connection with wholesale applications).

2.4 Sensitive Personal Information

We do not knowingly collect government-issued identification numbers (other than a wholesale account’s tax identification number), precise geolocation, account log-in credentials with security questions, biometric information, genetic information, or information about your physical or mental health diagnoses. We do not knowingly use or disclose sensitive personal information for the purpose of inferring characteristics about you.

3. How We Use Personal Information

We use personal information for the following business purposes:

  • Order fulfillment and customer service: to process and ship your orders, manage subscriptions, process returns and refunds, provide customer support, and communicate with you about your orders.
  • Account administration: to create and maintain your account, authenticate you, and secure your account.
  • Subscriptions and auto-renewals: to manage recurring billing, send required pre-renewal notices, and process cancellations and changes.
  • Wholesale operations: to evaluate wholesale- account applications, manage wholesale orders, administer credit terms, calculate trade promotions, and enforce minimum advertised price and channel policies.
  • Marketing and promotions: to send you email and SMS messages about our products, promotions, content, and events (subject to your communication preferences and applicable law); to operate sweepstakes, contests, and rewards programs; to personalize content and offers; and to deliver and measure advertising on and off the Sites.
  • Analytics and product improvement: to understand how visitors use the Sites, evaluate the performance of our marketing, develop new products, and improve our existing products and the Sites.
  • Research and surveys: to conduct consumer research, including with our research partners.
  • Trust, safety, security, and fraud prevention: to detect, investigate, prevent, and respond to fraud, unauthorized access, abuse, security incidents, and other harmful or illegal activity.
  • Legal and compliance: to comply with applicable laws, regulations, court orders, subpoenas, and other legal processes; to respond to government and regulatory inquiries; to establish, exercise, or defend legal claims; and to enforce our agreements.
  • Corporate transactions: in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction.
  • With your consent: for any other purpose disclosed to you at the time we collect the information or for which you have provided consent.

We may de-identify or aggregate personal information so that it no longer reasonably identifies you, and we may use and disclose such de-identified or aggregated information for any lawful purpose.

4. How We Disclose Personal Information

We disclose personal information to the following categories of recipients:

  • Affiliates and subsidiaries of BSF Nutrition Inc., where applicable.
  • Service providers and contractors that perform services on our behalf, including hosting and information- technology providers; our e-commerce platform; our subscription- management platform; our third-party logistics provider (Saddle Creek Logistics) and other warehousing and fulfillment partners; shipping carriers; payment processors and payment-fraud-prevention services; customer-service and helpdesk platforms; email and SMS service providers; analytics providers; advertising service providers; review and ratings platforms; market-research firms; auditors, accountants, and professional advisors; and similar service providers. These service providers are authorized to use personal information only as necessary to provide services to us.
  • Advertising partners, ad networks, social-media platforms, and analytics providers in connection with the operation of the Sites and the delivery and measurement of advertising — including, in some cases, through cookies and similar technologies that may constitute “sharing” or “targeted advertising” under certain U.S. state privacy laws (see Section 7).
  • Retailers, wholesalers, and authorized resellers for purposes of order fulfillment, channel administration, co- marketing, or — for wholesale accounts — administration of your account.
  • Co-promotion or co-marketing partners where you have consented or where otherwise permitted by law.
  • Government authorities, regulators, courts, and law-enforcement agencies as required by law, including in response to subpoenas, warrants, court orders, or other legal process; to comply with regulatory inquiries; and to protect our rights, property, safety, employees, customers, or others.
  • Prospective or actual acquirers, investors, and their professional advisors in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction.
  • Other parties with your consent or at your direction.

We do not disclose personal information in exchange for monetary consideration — that is, we do not “sell” personal information for money. However, our use of cookies and similar technologies to enable advertising on and off the Sites may constitute a “sale” or “share” of personal information for cross-context behavioral advertising under certain U.S. state privacy laws. See Section 7 for the rights and choices available to you, including the right to opt out.

5. Children's Privacy

The Sites are not directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13 in violation of the Children’s Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete such information. If you believe that a child under 13 has provided personal information to us, please contact us at legal@bloodsugarfriendly.com.

We also do not knowingly sell or share for cross-context behavioral advertising the personal information of consumers under 16 years of age without the consumer’s affirmative authorization (or, for consumers under 13, the affirmative authorization of the consumer’s parent or guardian) where required by law.

6. Cookies and Similar Technologies

We and our service providers, advertising partners, and analytics providers use cookies, pixels, web beacons, software development kits (SDKs), local storage, and similar technologies (collectively, “Cookies”) to operate the Sites, remember your preferences, analyze Site traffic and performance, personalize content and offers, and deliver and measure advertising.

We use the following categories of Cookies:

  • Strictly necessary Cookies are required for the Sites to function (for example, to maintain the contents of your shopping cart, authenticate you, or enable checkout). These cannot be disabled through our cookie controls.
  • Functional Cookies remember your preferences and settings and enable enhanced functionality.
  • Performance and analytics Cookies help us understand how visitors interact with the Sites, including by collecting information about pages viewed, clicks, errors, and other diagnostic data.
  • Advertising and targeting Cookies are used by us and our advertising partners to build profiles of your interests, deliver relevant advertising on and off the Sites, and measure the effectiveness of our advertising.

You can control Cookies through your browser settings, our cookie- preferences tool (where made available on the Sites), and the opt- out resources listed in Section 7. Disabling Cookies may affect the functionality of the Sites and your ability to use certain features.

We currently do not honor “Do Not Track” browser signals because no industry standard for such signals has been adopted. We do honor opt-out preference signals (including the Global Privacy Control, or “GPC”) to the extent required by applicable law (see Section 7).

7. Your Privacy Rights and Choices

7.1 Marketing Communications

You may opt out of marketing emails at any time by clicking the “unsubscribe” link in any marketing email we send you or by emailing legal@bloodsugarfriendly.com. You may opt out of marketing SMS messages by replying STOP to any marketing SMS message you receive from us. Standard message- and-data rates may apply. Even after you opt out of marketing communications, we may continue to send you transactional or service-related messages — for example, order confirmations, shipping notifications, subscription reminders, and customer- service responses.

7.2 Interest-Based Advertising

You may opt out of interest-based advertising delivered by participating companies through the Digital Advertising Alliance (DAA) at https://optout.aboutads.info, the Network Advertising Initiative (NAI) at https://optout.networkadvertising.org, or for mobile applications through the DAA AppChoices tool at https://youradchoices.com/appchoices. You may also adjust ad-personalization settings through your device or operating system.

7.3 Global Privacy Control

We treat the Global Privacy Control (GPC) signal, when transmitted by a browser or device on a per-frequent-user-identifier basis, as a valid request to opt out of the “sale” and “sharing” of your personal information for cross- context behavioral advertising for the corresponding browser or device, where required by applicable law.

7.4 Rights Under U.S. State Privacy Laws

Subject to certain exceptions and verification requirements, residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other U.S. states with comprehensive consumer- privacy laws (collectively, the “Applicable State Laws”) may have some or all of the following rights with respect to their personal information:

  • Right to know / access the categories and specific pieces of personal information we have collected about you, the categories of sources from which the information was collected, the business or commercial purposes for collecting, selling, or sharing the information, the categories of third parties with whom the information is shared, and (where required) the specific pieces of personal information disclosed.
  • Right to correct inaccurate personal information.
  • Right to delete personal information we have collected about you, subject to legal exceptions.
  • Right to data portability — to obtain a copy of personal information in a portable and, to the extent technically feasible, readily usable format.
  • Right to opt out of sale or sharingof personal information for purposes of cross-context behavioral advertising or for monetary or other valuable consideration. As described above, we do not sell personal information for money but our use of advertising Cookies may constitute “sale” or “sharing” under Applicable State Laws.
  • Right to opt out of targeted advertising and certain profiling that produces legal or similarly significant effects.
  • Right to limit the use and disclosure of sensitive personal information to certain enumerated purposes, where applicable.
  • Right to non-discrimination for exercising your privacy rights.
  • Right to appeal our denial of a privacy-rights request (where required by Applicable State Laws).

7.5 How to Exercise Your Rights

You may submit a privacy-rights request by emailing legal@bloodsugarfriendly.com, by writing to us at the address in Section 12, or — where made available on the Sites — through our online privacy-rights request form. You may also call us at the telephone number provided on the Sites’ contact page.

We will verify your identity before responding to a request involving access, correction, deletion, or portability. Verification may require us to confirm specific pieces of personal information we have on file about you, request a signed declaration under penalty of perjury, or take other reasonable measures appropriate to the sensitivity of the request.

You may use an authorized agent to submit a privacy-rights request on your behalf. We will require the agent to provide proof of your written authorization and may require you to verify your identity with us directly.

If we deny your request, we will notify you of the reason and — where required by Applicable State Laws — provide instructions for appealing our decision. To appeal, contact legal@bloodsugarfriendly.com with the subject line “Privacy Appeal.”

7.6 California Notice at Collection

In addition to the rights described above, California residents are entitled to the following information regarding the personal information we collect at or before the point of collection:

  • Categories of personal information collected: identifiers; California Customer Records Act personal-information categories; commercial information; internet or other electronic network activity information; geolocation data (approximate); audio, electronic, visual, or similar information (customer- service recordings); professional or employment-related information (for wholesale applicants); and inferences drawn from the foregoing.
  • Purposes for which the categories are collected and used: as described in Section 3 of this Policy.
  • Whether personal information is sold or shared: as described in Section 4, we do not “sell” personal information for monetary consideration, but our use of advertising Cookies may constitute “sale” or “sharing” of personal information for cross-context behavioral advertising under the California Consumer Privacy Act (as amended) (CCPA).
  • Length of time we retain personal information: as described in Section 9.
  • Categories of sources of personal information: as described in Section 2.
  • Categories of third parties to whom we disclose personal information: as described in Section 4.

California residents may also request information about our disclosures of personal information to third parties for those third parties’ own direct-marketing purposes pursuant to California Civil Code § 1798.83 (“Shine the Light”). To make such a request, contact legal@bloodsugarfriendly.com with the subject line “Shine the Light Request.” We will respond within the time period required by law.

8. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

9. Data Retention

We retain personal information for as long as is reasonably necessary to fulfill the purposes for which it was collected, including to provide our products and services, maintain our records, comply with our legal obligations (including tax, accounting, and consumer-protection record-keeping requirements), resolve disputes, enforce our agreements, and exercise or defend legal claims. When we no longer need personal information, we will delete, destroy, or de-identify it in accordance with our retention schedule and applicable law.

10. Third-Party Sites and Services

The Sites may contain links to third-party websites, applications, or services that we do not own or control. This Policy does not apply to those third-party properties. We encourage you to review the privacy policies of any third-party properties before providing them with personal information.

The Sites may also enable interaction with third-party social-media platforms (for example, by allowing you to share content or log in through a social-media account). Your interactions with those platforms are governed by their own privacy policies and terms.

11. United States Processing; No International Offering

The Sites are intended for and directed to users located in the United States. We do not knowingly offer the Sites or our products to individuals located outside the United States. By using the Sites, you represent that you are located in the United States and consent to the processing of your personal information in the United States in accordance with this Policy and applicable U.S. law.

If you are located outside the United States, please do not use the Sites or provide personal information to us.
